The English texts come from the official English versions published by the European Union (EU) on EUR-Lex, the United Kingdom (UK) on GOV.UK and UK Parliament, and Gibraltar (the Acts and legal notices that change Gibraltar's law for the treaty, from Gibraltar Laws and the Gibraltar Gazette, and Gibraltar Parliament records: Hansard, Bills and Command Papers), plus HM Government of Gibraltar and European Commission press releases where a statement is quoted. Where a text exists only in Spanish (BOE), we quote it in Spanish and say so, and any translation beside it is ours.

No official text we hold gives Gibraltar residents or visitors a health card that works in Spanish public hospitals. Workers who live in Spain and work in Gibraltar, and their families, are covered by the treaty's social security rules and are entitled to care in the place where they live once registered there. Planned treatment for Gibraltar patients in Spanish hospitals goes through the Gibraltar Health Authority (GHA), and the Gibraltar Government runs a scheme for emergency treatment in Andalucía for some older residents.
The Gibraltar Government's 2020 notice said that, unless an agreement said otherwise, European Health Insurance Cards issued in Gibraltar would stop being valid in EU countries, including Spain, from 1 January 2021 for state-provided healthcare, including emergency care, during a temporary stay. It advised the public to have travel insurance with medical cover for any trip to the EU, including Spain. That notice was written before the 2026 treaty and we hold no later Government notice on this.
On 4 March 2026 the Chief Minister told the Gibraltar Parliament that no deal on the E111 had been negotiated because the EU did not want one, and referred to a bilateral health care agreement between Gibraltar and Spain as "a post-treaty thing to do" that is "on our list of things to do" and that Spain have said they are interested in. The printed record reads "We are not going to look at the possibility of a" in the clause just before that passage, which sits oddly with the rest; we quote it and do not interpret it. An Opposition Member said in the same debate that the UK Global Health Insurance Card (GHIC) arrangements were not extended to Gibraltar; that is a Member's statement, not a Government finding.
Spanish side: Spain's 2020 decree-law set a temporary regime under which people entitled to care in the UK or in Gibraltar received care from the Spanish National Health System on the same terms as before 1 January 2021, as long as the UK gave reciprocal care to people entitled to care from Spain and reimbursed Spain's costs; the text we hold shows it was extended for Gibraltar, the last extension running to 30 June 2022 (Order PCM/1482/2021), and says the measures stop applying if an EU-UK agreement on Gibraltar that includes access to health care in its scope enters into force. We hold no later Spanish text on whether it was extended beyond 30 June 2022, or on its status now: no official source found.
Whether the treaty gives Gibraltar residents in general a health card or cover in Spanish public hospitals: we searched the treaty text we hold for the words EHIC, GHIC and health insurance and found none (the frontier workers block below covers the one group the protocol does cover): no official source found for any other group.
Some referrals for specialist (tertiary) care are delivered in the National Health Service (NHS) in the UK and in Spanish hospitals because of the proximity, according to the Government's health page. The 2020 notice says the GHA has secured individual arrangements with certain Spanish private healthcare providers so that Gibraltar patients can still be referred for planned treatment.
Two 2019 press releases name providers: Hospiten Group (medical centres in Estepona and Algeciras) and Grupo Vithas (Vithas Xanit International Hospital in Benalmádena and Vithas Parque San Antonio Hospital in Málaga). We hold no current list of the providers the GHA uses (the treaty's list of seven Spanish providers, in section 6, is for ambulance services): no official source found.
If you are a sponsored patient travelling for treatment, the GHA reminds you to have a passport with at least 6 months' validity and a valid ID card; invalid documents could delay tertiary care. Contact: the Sponsored Patients Department.
Paying for private care in Spain yourself, without a GHA referral: no official source found.
The Gibraltar Government's Travel Scheme for Eligible Elderly Resident Citizens is for elderly British citizens aged 60 to 90 who solely reside in Gibraltar and are registered with the GHA. It is only for emergency medical treatment while travelling to Andalucía, southern Spain, and the Government reimburses covered medical costs within the scheme's terms and conditions. People over 90 must apply for approval with a separate form; that approval is valid for three months from the date of approval, and over-90s must be accompanied by a family member to qualify for reimbursement. Registration is open indefinitely.
Spanish side: the scheme is a Gibraltar Government reimbursement scheme. We found no Spanish official text about it, including on the Andalusian regional government (Junta de Andalucía) page we hold, and we could not read the Servicio Andaluz de Salud site (it refused the request), which does not prove that no page exists: no official source found.
Who is covered. The treaty's social security protocol covers EU citizens legally living in Spain who are or were subject to Gibraltar law as frontier workers in Gibraltar, with their family members and survivors living in Spain, and UK nationals legally living in Gibraltar who are or were subject to Spanish law as frontier workers in Spain, with their families. An employed frontier worker is a covered person who works in Gibraltar or in Spain and returns at least once a week to Spain or to Gibraltar, respectively. The SEPE says the treaty has applied to all branches of social security since 15 July 2026, but only to frontier workers as it defines them.
Care where you live. A frontier worker (or detached frontier worker) subject to Gibraltar or Spanish law who lives in Spain or Gibraltar, and the family, are entitled to care in the place of residence, given by the institution of the place of residence on behalf of the competent institution, under the rules of the place of residence, as if insured there. To use it, the worker or family member must register with the institution of the place of residence, and the right is certified by a document issued by the competent institution on request of the insured person or of the institution of the place of residence. If a person is exempt from compulsory health insurance on request, the other side's institution is not responsible for the cost only because of that exemption.
Care while staying in the place of work. Frontier workers, detached frontier workers and posted workers are entitled to care while staying in the place of employment; for frontier workers it is provided by the competent institution at its own expense, as though they resided there. A posted worker's entitlement is narrower: care that becomes necessary on medical grounds during the stay, not where the person travelled in order to receive it. The document is, for a worker posted to Gibraltar, a valid European Health Card (tarjeta sanitaria europea) issued by the Spanish institution together with the form certifying the applicable law; for a worker posted to Spain, a letter certificate from the Gibraltar institution with the same data.
Retired and pensioners. A frontier worker retired for old age or invalidity may continue, in the event of sickness, to receive care in the place where the person last worked, insofar as it continues a treatment that began in Gibraltar or in Spain respectively, and, if the former worker is no longer covered by the legislation of the place where the last activity was pursued, the former worker or a family member who travels there for it must show a document from the competent institution. A person who receives pensions from both sides and is entitled to care in the place of residence receives it, with the family, from and at the expense of the institution of the place of residence.
Offices. The administrative arrangement names the contact bodies: for Spain the National Social Security Institute (INSS) for all schemes and benefits except the seafarers' special scheme, the State civil-service pension regime and unemployment benefits, and for Gibraltar, among others, the Gibraltar Health Authority and, for reimbursement claims, the UK National Health Service Business Services Authority. Which Spanish health service office issues the health card in practice, and its steps: no official source found. The Spanish health pages we tried (Servicio Andaluz de Salud, Ministry of Health, Social Security portal) refused the request, did not load or had no readable terms, which does not prove that no page exists.
No official text we hold sets health cover for a visitor who needs care in a Spanish hospital: no official source found. The only official advice we hold on this, written for Gibraltar residents in 2020 and not updated, is to have travel insurance with medical cover for any trip to the EU, including Spain. The right described in the treaty for a person posted to work temporarily in the other territory is narrower (care that becomes necessary on medical grounds during the stay, not where the person travelled in order to receive it, shown with the document described in the previous section); it is not a visitor's right.
The treaty obliges the EU to allow, within its territory, emergency ambulance services run by operators established in Gibraltar under the direction of the GHA, and ambulance services for the specialist handling of serious and acute medical conditions between Gibraltar and the establishments listed in its Annex 26. The list names seven providers, in La Línea de la Concepción, Palmones, Algeciras, Benalmádena, Málaga and Jerez. This is about ambulances; it does not by itself give any person a right to treatment or say who pays.
If there is no agreement to the contrary, European Health Insurance Cards issued in Gibraltar will, as from 1 January 2021, no longer be valid in EU Member States (including Spain) for the purposes of accessing state-provided healthcare (including emergency healthcare) during a temporary stay in the EU.HM Government of Gibraltar, Technical Notice (12), «European Health Insurance Cards and Healthcare», 18 November 2020 (written before the 2026 treaty), section «Emergency Healthcare in the EU»
