Where the texts come from

The English texts come from the official English versions published by the European Union (EU) on EUR-Lex, the United Kingdom (UK) on GOV.UK and UK Parliament, and Gibraltar (the Acts and legal notices that change Gibraltar's law for the treaty, from Gibraltar Laws and the Gibraltar Gazette, and Gibraltar Parliament records: Hansard, Bills and Command Papers), plus HM Government of Gibraltar and European Commission press releases where a statement is quoted. Where a text exists only in Spanish (BOE), we quote it in Spanish and say so, and any translation beside it is ours.

The Spanish side: the Spanish version of the treaty says that from the date of provisional application the references to the date of entry into force are read as that date. Spain's Foreign Ministry says the treaty was signed in Brussels on 14 July 2026 and applies from the next day, 15 July, and that one formal step remains, ratification by the European Parliament. The Spanish Tax Agency (AEAT) note of 6 April 2026 says provisional application had been put back to 15 July; its page of 14 July writes "entra en vigor" (enters into force), while the certified row uses the treaty's own words, provisional application.

15 July to 12 October 2026 (Deductions Rules); extensions by the MinisterCertified retail and wholesale businesses could deduct from their assessable profits the difference between the Transaction Tax paid and the import duty that would otherwise have been payable, where the tax is higher, in the 90 days that begin on the Implementation Date; the deduction is capped at 50% of the tax paid in the previous period. Food, drink and grocery, tobacco, wine and spirits, fuel and vehicle businesses are excluded. A business also had to be up to date with its tax, PAYE and social insurance on 15 July 2026, or become so within 30 days with the written approval of the Commissioner of Income Tax, and every deduction has to meet the de minimis state aid rules. The Government's release says that period ends on 12 October 2026. The Minister may extend it by a further 90 days by Gazette notice. The Spanish side: the Spanish version of the treaty says: the rules on goods do not apply to goods whose movement began before entry into force and ended after it, and that exception stops applying two months after entry into force; the treaty's indirect-tax provisions do not apply to goods covered by an import-duty exemption certificate issued before entry into force under the 2017 Gibraltar tariff regulations, for the certificate's duration or three months from entry into force, whichever is shorter, provided the UK, for Gibraltar, has given the EU authorities copies of the current certificates with the quantities of the goods imported in the last three years, and the quantities imported are proportionate to the projects the certificate refers to; goods legally marketed in Gibraltar before entry into force are not subject to the treaty's product requirements for three months from that date; and goods in temporary storage or in a special customs procedure begun under the old law stay under that law if the procedure is not completed, and at the latest two months after entry into force (for temporary storage, until the legal period for it ends). Counting entry into force as 15 July 2026, these periods have ended; no official text we hold writes the calendar day: no official source found for the day.

The Spanish side: the Spanish version of the treaty gives EUR 430 per person for travellers by air and sea, EUR 300 for travellers by land, and EUR 175 for travellers under fifteen. The Spanish Tax Agency (AEAT) says the allowances disappear once, after 3 years from the start, Gibraltar has reached the standard Transaction Tax rate (a rate not lower than the lowest applied by an EU country); until then, non-commercial goods above the allowances must be declared and duty and tax paid. This is a third statement: it ties the end of the allowances to the rate being reached as well as to the 3 years, and it does not settle the question the certified row leaves open (the Government's FAQ against the treaty's own text). From 15 July 2026: residents of Gibraltar exempt from EES and ETIASPersons resident in Gibraltar are exempt from the Entry/Exit System (EES), no entry or exit stamp goes in their travel documents, and they do not need an ETIAS travel authorisation. The Government's notice, written for holders of Gibraltar identity cards and civilian registration cards, says the exemption applies at all Schengen external borders and that a registration made on the EES after 15 July 2026 should not have been required. The Spanish side: the Spanish version of the treaty says that no entry or exit stamp is placed in the travel documents of residents of Gibraltar when they cross the external border of an EU country, that residents of Gibraltar are exempt from the requirements of the Entry/Exit System, and that they are exempt from the obligation under the ETIAS Regulation (EU) 2018/1240 to hold a valid travel authorisation. Administrative Arrangement says that at the airport, Schengen checks on persons covered by Article of the treaty who are over the age of eligibility for e-gates, and on third-country nationals registered in the EU Entry/Exit System, are done through e-gates, and checks on all other passengers who are not eligible or cannot use automated control are done at staffed Schengen immigration booths. Spain's Foreign Ministry says Spain will take on the Schengen checks at Gibraltar's airport and port. We hold no Spanish text on a start date of EES or ETIAS for visitors: no official source found.

  • The Spanish side: an office of the Spanish Tax Agency (AEAT) in Andalucía has published instructions saying that the EORI needs a NIF issued by the AEAT and that both are requested in one application, online or in person at any AEAT office. The AEAT also advises Gibraltar operators to act through a customs representative in Spain, among other reasons because the representative can use the AEAT electronic office. For re-exports from Gibraltar by sea or air, the AEAT tutorial says the exporter must have a NIF and an EORI unless acting through an indirect representative.

  • The Spanish side: the Spanish public employment service (SEPE) says the treaty has applied since 15 July 2026 to all branches of social security, and replaces the 2020 Spanish decree-law for unemployment protection of this group. The SEPE says it applies only to frontier workers: EU citizens living in Spain who work in Gibraltar and return to Spain at least once a week, and UK citizens living in Gibraltar who work in Spain and return at least once a week; it excludes workers who stay away more than a week, UK citizens living in Spain who work in Gibraltar, and non-EU nationals, even if they are frontier workers. The Andalusian regional government (Junta de Andalucía) lists its Brexit offices in La Línea de la Concepción and Algeciras for frontier workers' questions. The Spanish version of the treaty says frontier workers covered by it have the right to be issued a document proving their status, which may be digital; which Spanish office issues it, and how: no official source found.

  • The Spanish side: the Spanish version of the treaty gives the non-commercial allowances: EUR 430 per person by air and sea, EUR 300 by land and EUR 175 under fifteen; for tobacco by land, 200 cigarettes (80 for residents or frontier-zone workers), 100 cigarillos, 50 cigars and 250 g of smoking tobacco; one litre in total of drinks above 22% vol. (or undenatured ethyl alcohol of 80% vol. and over) and two litres of drinks below 22% vol.; four litres of still wine and sixteen litres of beer (exempt from indirect taxes); and no allowances for tobacco and alcohol for travellers under seventeen.

One point to check: the Spanish text says the two-litre category is drinks "inferior al 22 % vol." (below 22%), while the English text we hold says "not exceeding 22 % vol." (22% or less, as in the certified item). The two language versions differ at exactly 22%; we note it and do not choose.

The Spanish Tax Agency (AEAT) says that for travellers coming from third countries into Gibraltar by its port or airport, a traveller carrying more than the allowances must declare it so that the Spanish authority can assess the import duties (and, for a person not resident in Gibraltar, the indirect taxes).
