What the treaty texts and the published record leave open: who holds each answer, what would settle it, and what has been answered.
The English texts come from the official English versions published by the European Union (EU) on EUR-Lex, the United Kingdom (UK) on GOV.UK and UK Parliament, and Gibraltar (the Acts and legal notices that change Gibraltar's law for the treaty, from Gibraltar Laws and the Gibraltar Gazette, and Gibraltar Parliament records: Hansard, Bills and Command Papers), plus HM Government of Gibraltar and European Commission press releases where a statement is quoted. Where a text exists only in Spanish (BOE), we quote it in Spanish and say so, and any translation beside it is ours.

Gathers: border crossing point · the treaty's exception for the port · lists sent under the port manifest regulations · Yacht and Port Portal access terms · which data-protection instrument governs that access. The regulations laid on 16 July under that title are the 2026 port manifest regulations, which the pack holds. Gibraltar's 2026 regulations on border checks and alerts say what happens meanwhile: while the treaty's exception for the port applies, passengers and crew arriving at the port who need Schengen checks are taken to the airport by immigration officers accompanied by Schengen officers, and back again on departure, and refusing is an offence, so there is no crossing point at the port yet, and the question is what happens when the traffic threshold is crossed Read the texts on thisWhere is the maritime border crossing point, has the Article 29(3) derogation been invoked, how many crew and passenger lists have gone to Spain under LN 221, and what are the terms of Spain's real-time access to the Yacht and Port Portals: retention, onward transfer, logging, audit? | the conditions for cruise calls and crew changes, and the data rules that apply | the Port Authority; HM Customs; the Data Protection Commissioner | spring 2027 | 3 September 2026 | Open |

| 22 | Has the airport joint venture the treaty provides for been constituted, where, and with what instrument for Gibraltar Air Terminal Ltd; how does the Government's statement that there would be no change to the current operator without its consent reconcile with the procurement the treaty sets for the joint venture; on what basis may an EU carrier fly before it exists; and do the treaty's other airport rules operate before it does, given how the treaty defines Gibraltar airport? Gathers: JV in Ireland · GATL instrument and tender · operator consent · EU carriers before the JV · the other airport rules. Part answered: a 2026 Legal Notice on airport charges defines the operator of the Civil Airport as the person appointed under Gibraltar's civil aviation law, so the instrument is an appointment under that law; whether it was tendered remains. That notice's charging rules apply only when the airport handles over five million passenger movements a year, so they do not apply at present; another 2026 notice opens groundhandling to competition, with the operator able to limit suppliers in four categories and an Airport Users' Committee · two more 2026 notices, on passengers with reduced mobility and on slot allocation, put every airport-side duty on the operator appointed under that law and leave the joint arrangements untouched; the slot notice names no slot coordinator; the airport can become a coordinated airport only after a capacity analysis, carried out when the Director General considers it necessary, or within six months of a request from the Director General, or from the airport operator or airlines running more than half of the airport's flights when they consider capacity insufficient, and then, for the periods concerned, only where capacity problems last at least one scheduling period, the shortfall is so serious that significant delays cannot be avoided and the problems cannot be resolved in the short term, or, as an exception, where the Director General so decides in exceptional circumstances Read the texts on thisHas the Article 274 joint venture been constituted, where, with what instrument for Gibraltar Air Terminal Ltd; how does the Government's statement that there would be no change to the current operator without its consent reconcile with Article 274's procurement; on what basis may a Union carrier fly before it exists; and do Articles 272–273 operate before it does, given 271(d)? | the position on route rights under the treaty | the Government (the Deputy Chief Minister) | none | 3 September 2026 | Open |

Gathers: whether that notification was made: answered: a Legal Notice of 23 July 2026 records that the UK, for Gibraltar, makes no notification under either of two treaty provisions · the date of transmission (that Legal Notice took effect on 23 July, after the 15 July date that the treaty sets for most items) · the description of the Attorney General's competences that the treaty calls for, which is not in the notice Read the texts on thisWhy did the UK, for Gibraltar, make no Article 122(2) notification, and is the 2030 window in the diary; when were Gibraltar's Article 68 notifications sent to the EU, and through the FCDO as Article 6(3) requires; has the UK ratified; which EU countries notified under Article 68(5); were the four declarations adopted and where? | the treaty's own paperwork | the Government; the FCDO, by UK freedom-of-information request | the three months before the fourth anniversary of entry into force | 15 September 2026 | Open |

Gathers: the Tobacco Protocol Regulations 2026, laid 13 July, make the Collector the competent authority for the exchange, with a seven-day response to requests and the form attached to the tobacco arrangement as the form; they cover the exchange, not the collection: the quarterly exchange is the Collector's own duty (under an Act and under those Regulations), but no instrument obliges operators to report volumes by brand and operator, and the arrangement's form has no line for it; the traceability repository set up by a 2026 Legal Notice records brand for cigarettes and hand-rolling tobacco and is the only source the Collector has; another 2026 notice sets the specific duty at £121 per 1,000 cigarettes, and the treaty requires the specific element to be between 7.5% and 76.5% of the total tax burden and the whole at least EUR 115 per 1,000; and the Statistics Office has published no import statistics since the 2016 Abstract, so no volume is in the public record from that side either Read the texts on thisHas the tobacco traceability system under PTOB.3 been built; what did the first quarterly exchange on 30 November 2026 contain; has any minimum-price notice appeared since 14 July; which Gibraltar instrument requires operators to supply brand-level volumes and prices; what is the ad valorem rate on cigarettes, and does the £121 specific duty sit inside Annex 24's bands? | the lever Spain holds | the Government (customs); the Gazette | 30 September and 30 November 2026 | 3 September 2026 | Open |

Gathers: pursuit declaration · surveillance decision · at sea · no data-protection arrangement · functions with Spain · whether the Spanish officers in the airport booths wear uniform, as the border-checks arrangement permits (it permits uniform and does not require it). Gibraltar's Uninterrupted Pursuit Regulations 2026, laid on 8 July, prescribe that until the pursuit declaration is made, pursuing officers may not apprehend; the question is now whether a declaration will be made, and what it will say. Gibraltar's 2026 regulations on border checks and alerts provide that joint sea patrols run in jointly crewed vessels, and that an arrest at sea is made by the authority of the territory where the person is apprehended under that territory's law: the rule is in Gibraltar law; which waters are whose is still the question.
