How Gibraltar's law was changed for the treaty

The Legal Notices of 2026 that changed Gibraltar's law for : what each does, who it affects and from when, and where to read the official text.

6 October 2026

Gibraltar Laws last checked for new or changed notices: 19 October 2026.

Where the texts come from

The English texts on this page come from the official English versions published by Gibraltar (the Act and the Legal Notices, from Gibraltar Laws and the Gibraltar Gazette, and Hansard) and the European Union (EU) on EUR-Lex (the Agreement), plus HM Government of Gibraltar and European Commission press releases where a statement is quoted. Where a text exists only in Spanish (BOE), we quote it in Spanish and say so, and any translation beside it is ours.

What this page covers

This page lists the Legal Notices of 2026, and four Acts of Parliament of 2026, that change Gibraltar's law for the treaty between the and the , or will change it once in force. For each notice or Act it says what it does, who it affects and from when, how it is tied to the treaty (for a notice that names the treaty, only the part the notice itself names), and where to read the official text. It also says what the Act that gives effect to the treaty requires for these notices, and how many there are on a stated test. It ends with laws still to come.

A Legal Notice is a law or an official decision made under an Act of Parliament. It is published, with a number, in the Gibraltar Gazette, the Government's official journal. The notices on this page that are held in their Gazette form appear in the Second Supplement to the Gazette under a heading that gives the notice's number and year. This page writes that in short form: LN, then the number, a slash and the year.

A Legal Notice is a law or an official decision made under an Act of Parliament. It is published, with a number, in the Gibraltar Gazette, the Government's official journal. Those notices on this page that are held in their Gazette form appear in the Second Supplement to the Gazette under a heading such as "LEGAL NOTICE NO. 165 OF 2026". This page writes that as LN 165/2026.

A Legal Notice is made by the person the Act names, not by a vote of Parliament. Most notices on this page say who made them. For most it is the Government, signed by a Minister. Some were made by the Chief Minister. One was made by a Minister in the Minister's own name, one by the Director General of the Gibraltar Civil Aviation Authority and one by the Chief Justice. The corrections do not say who made them. The notices on this page are of several kinds. Regulations, orders and rules set rules. Commencement notices say when a law starts. Corrections, called corrigenda, correct a published text. Designations name the body that is to carry out a task. There is also one list of notifications sent to the EU.

The power in the Act, and what the Act requires of Parliament

The Act is Gibraltar's 2026 Act that brings the treaty into Gibraltar law. Its main power lets the Government make regulations containing any provision that appears to the Government to be necessary or suitable for an implementation purpose. The Act calls these regulations Implementation Regulations, meaning regulations made under this power. The Act also says what an implementation purpose is. It means giving effect to any provision of the TGEU (the treaty). It also means giving effect to arrangements between two governments: His Majesty's Government of the United Kingdom, for Gibraltar, and the Government of Spain. The arrangements are those setting out practical arrangements for implementing the TGEU.

The Act is the Treaty on Gibraltar and the European Union Act 2026. Section 13(1) gives the main power: "The Government may by regulations ... make any provision that appears to the Government to be necessary or expedient for an implementation purpose." The Act calls these regulations "Implementation Regulations". Section 7(1) says an "implementation purpose" means giving effect to "any provision of the TGEU" (the treaty) and to arrangements between His Majesty's Government of the UK, for Gibraltar, and the Government of Spain "setting out practical arrangements for the purposes of the implementation of the TGEU."

The full title of Gibraltar's 2026 Act that brings the treaty into Gibraltar law is the Treaty on Gibraltar and the European Union Act 2026.

The Act lists what Implementation Regulations may do. The first item on the list is to make any kind of provision that an Act of Parliament could make, including changes to the Act itself. The list has 17 items in all.

Section 13(2) lists what Implementation Regulations may do. The first item, section 13(2)(a), is to "make provision of any kind that could be made by Act of Parliament (including modifying this Act);". The list goes on to item (q).

What the Act requires for Parliament is in two subsections of one of its sections. To lay a document before Parliament means to put it formally before the Members.

What the Act requires for Parliament is in section 13(4) and (5). To "lay" a document before Parliament means to put it formally before the Members.

What the Act does not say: it sets no vote of Parliament to approve Implementation Regulations. It sets no procedure for Parliament to cancel them. It sets no time limit for laying them other than that they be laid as soon as they reasonably can be. This was checked by reading the section of the Act that sets out what it requires for Parliament, and by searching the whole Act for the words resolution, annul, approv, affirm, negative and laid.

What the Act does not say: it sets no vote of Parliament to approve Implementation Regulations. It sets no procedure for Parliament to cancel them. It sets no time limit for laying them other than "as soon as practicable". This was checked by reading section 13 and by searching the whole Act for the words "resolution", "annul", "approv", "affirm", "negative" and "laid".

The Act says that one provision of the Interpretation and General Clauses Act does not apply to any Implementation Regulations made under the Act's power to make them. That Act was not among the texts read for this page, so this page does not say what that provision says.

Section 13(3) says: "Section 23(b) of the Interpretation and General Clauses Act shall not apply to any Implementation Regulations made under this section." That Act was not among the texts read for this page, so this page does not say what section 23(b) provides.

Separately, the Act says the Chief Minister must publish reports, called Treaty Implementation Reports, and lay them before Parliament. Each report must identify, and describe the purpose and effect of, any Implementation Regulations made since the previous Treaty Implementation Report. A report is to be produced at times the Chief Minister thinks appropriate. But a report must be produced at least once in each calendar year after the date on which provisional application of the treaty starts.

Separately, section 21 of the Act says the Chief Minister "shall publish and lay before Parliament reports ("Treaty Implementation Reports")". Each report must "specify, and describe the purpose and effect of, any Implementation Regulations made since the previous Treaty Implementation Report" (section 21(3)(b)). A report is to be produced at times the Chief Minister thinks appropriate, but "not less than once in each calendar year after the date on which provisional application of the TGEU shall have commenced" (section 21(2)).

The notices on this page do not all rely on the same power:

By its words, the Act's rule on laying regulations before Parliament applies to Implementation Regulations, including those made partly under the Act's power to make regulations. Its words do not cover notices made only under another Act. Whether those other Acts require laying was not checked for this page.

Laying shown in the official record of Parliament (Hansard):

In Parliament on 30 March 2026 (second reading of the Bill; Hansard, morning session, page 8), the Chief Minister said the Bill would require some secondary legislation made in pursuit of its aims to be laid in Parliament as well. He also said Parliament keeps oversight through the obligation to lay secondary legislation made under the Bill's powers to make law. This page shows these as the Chief Minister's statement. The Act's own words on laying are those set out above.

How many notices this page counts

At 19 October 2026 this page counted 96 Legal Notices of 2026 tied to the treaty by their own text. On 24 October 2026 it adds one more notice, on excise duty rates, so it now counts 97, tied to the treaty in the same way. Each of the 97 names Gibraltar's 2026 Act that brings the treaty into Gibraltar law as its legal power or in its heading, or says it gives effect to the treaty, or corrects, starts or acts under a notice that does. The 97 include 10 corrections, 3 commencement notices, 2 designations of authorities and 1 list of notifications; the added notice is none of these. Of the first 96, 58 appear in the list named Treaty on Gibraltar on gibraltarlaws.gov.gi (as we read it on 19 October 2026); the added notice appears in that list as we read it on 24 October 2026; the other 38 do not.

The full title of Gibraltar's 2026 Act that brings the treaty into Gibraltar law is the Treaty on Gibraltar and the European Union Act 2026.

This page also lists, outside the 97, four Acts of Parliament of 2026, on deforestation, energy efficiency, trade in endangered species and ozone-depleting substances (three of them name the treaty in their own long titles: those on deforestation and on trade in endangered species, and the ozone Act in its long title as corrected; the energy efficiency Act, as corrected, does not), and 12 more Legal Notices of 2026 that are not among the 97 because their own text does not tie them to the treaty in the ways above. For these, the Government has said in its own statements that they serve the treaty, or they rely on the Act that gives effect to the treaty, amend, correct or start a law on this page, or do what the treaty requires without naming it. Each entry says how it is tied to the treaty. In all, the page has entries for 109 Legal Notices and 4 Acts.

Not counted and not listed: the third set of 2026 regulations amending employment law, which mention the Act but do not say they give effect to the treaty, and two notices on the Port Rules, which make no reference to the treaty. The 2026 rules giving certain shops and wholesalers a deduction from their taxable profits linked to the transaction tax they paid, and two of the 2026 notices setting minimum retail prices for tobacco (those in force from 15 July 2026 and from 1 October 2026), are not counted in the 97 but are listed, as set out above. The notices published on gibraltarlaws.gov.gi up to 19 October 2026 were read for this page; the ten published after 5 October 2026 are not tied to the treaty. The excise duty notice, which the list gives under 19 October 2026, was read on 24 October 2026 and is added.

Excise and tobacco

These thirteen notices change the rules on tobacco packs, tobacco tracking, selling tobacco at a distance to consumers outside Gibraltar, minimum retail prices for tobacco and excise duty (a tax on goods such as tobacco and alcohol). They also set how the Collector of Customs and HM Customs Gibraltar exchange tobacco and tax information with the EU and its member countries.

A Bill is not a Legal Notice and is not counted on this page. The Tobacco (Amendment) Bill 2026 (B27/26), published in the Gazette on 2 October 2026, would amend the Tobacco Act 1997 and was on the order paper of the Gibraltar Parliament for 14 October 2026. Parliament's revised agenda for that sitting lists it with a footnote that it cannot be proceeded upon before Saturday 14 November 2026, and the record of that sitting (Hansard) had not been published on parliament.gi when this page was updated, on 19 October 2026. Four of its changes are about quantities of cigarettes. The Act defines a “commercial quantity” of cigarettes as 2,000 or more, and the Bill would make that 100,000 or more. In a Special Zone, which the Chief Minister may declare by notice in the Gazette, the Act sets it at 600 and the Bill would set it at 2,000. The Bill would delete the rule that no offence is committed by carrying cigarettes in a motor vehicle if the amount, although a commercial quantity, is no more than 1,999 for each adult in the vehicle. And it would let a retail licence holder sell unused stocks of cigarettes, in any quantity, to another retail licence holder. Its explanatory memorandum says that it modernises the licensing of tobacco in keeping with the treaty, and it moves several licensing powers from the Collector of Customs to the Minister. It is not law until Parliament passes it.

Product rules and environment

These notices change Gibraltar's rules on the environment, climate, energy, waste, chemicals and some products sold to consumers, and so do four Acts of Parliament: those on deforestation (in force since 24 July 2026) and on energy efficiency (in force since 1 April 2026), and those on trade in endangered species and on ozone-depleting substances, which will change them only once the Minister sets a start date by notice in the Gazette (for the endangered species Act, different dates may be set for different parts or purposes). Most say they are made to carry out a part of the treaty that says the UK, for Gibraltar, must maintain environmental and climate levels of protection equivalent to the levels in place in the EU. This includes effectively enforcing environmental and climate law that applies to and in Gibraltar.

These notices change Gibraltar's rules on the environment, climate, energy, waste, chemicals and some products sold to consumers; most say they are made for Article of the treaty, which reads: "The United Kingdom, in respect of Gibraltar, shall uphold environmental and climate levels of protection that are equivalent to the levels in place in the Union, including by effectively enforcing environmental and climate law applicable to and in Gibraltar."

The endangered species Act, Act No. 17 of 2026, is made, by its long title, "for the purposes of the implementation of Article 219(4)" of the treaty. Section 2: "This Act comes into operation on such date as the Minister may appoint by notice published in the Gazette and different days may be appointed for different provisions or different purposes."

The deforestation Act, Act No. 14 of 2026, is made, by its long title, "FOR THE PURPOSES OF THE IMPLEMENTATION OF ARTICLE 219(4) OF THE AGREEMENT IN RESPECT OF GIBRALTAR"; LN 256/2026 appointed 24 July 2026 as "the day the Act comes into operation". The energy efficiency Act, Act No. 16 of 2026, section 2: "This Act comes into operation on the day of publication." The ozone Act, Act No. 18 of 2026, as its long title was corrected by LN 71/2026: "for the purposes of the implementation of Article 219(4) of the Agreement in respect of Gibraltar"; section 2: "This Act comes into operation on a date to be appointed by the Minister by notice in the Gazette."
